These Terms of Service ("Terms") govern your use of the website, services, and any content or materials provided by Surrey Fingerprint Company ("we," "us," "our," or "Company"). 1.1 Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our services. By using our website and services, you represent and warrant that you meet these requirements.

You agree to use our services only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment. Prohibited behavior includes:

  • Harassing or causing distress or inconvenience to any person;
  • Transmitting obscene or offensive content or disrupting the normal flow of dialogue within our website;
  • Attempting to gain unauthorized access to our systems or networks;
  • Using the website to collect or track personal information of others without consent;
  • Using automated tools (bots, scrapers) to access our services without authorization;
  • Reselling or redistributing our services or content without permission.

1.3 Appointment Booking

When you book a fingerprinting appointment through our website, you agree to:

  • Provide accurate, current, and complete information;
  • Arrive on time for your scheduled appointment;
  • Bring valid government-issued photo identification;
  • Comply with all RCMP fingerprinting procedures and standards;
  • Pay the applicable service fee at the time of service unless other arrangements have been agreed upon in writing.

2. SMS/Text Message Communications

2.1 Opt-In Consent

By checking the optional SMS consent checkbox during the appointment booking process, you affirmatively consent to receive text message (SMS) communications from Surrey Fingerprint Company. This consent is entirely optional and is NOT required to complete a booking or receive your appointment confirmation. Checking this box is a separate, voluntary choice to also receive appointment reminders via text message.

2.2 Message Content

You may receive the following types of SMS messages:

  • Appointment confirmation messages;
  • Appointment reminder messages (24 hours before and 2 hours before your appointment);
  • Service-related updates relevant to your booked appointment.

SMS messages may include your appointment details, date, time, location, and instructions. Messages may contain a callback phone number.

2.3 Message Frequency and Rates

Message frequency varies based on your appointment schedule and preferences. Standard message and data rates may apply. You are responsible for any SMS charges imposed by your wireless carrier. We recommend contacting your carrier to understand your plan's messaging rates.

2.4 Opt-Out Instructions

You can opt out of SMS communications at any time by:

  • Replying to any SMS with the word "STOP";
  • Replying with the word "UNSUBSCRIBE";
  • Contacting us at 604-825-8882 to request removal.

After you opt out, we will stop sending SMS messages. Transactional messages related to appointment confirmations may continue if required by law. Reply "HELP" to any SMS message for additional support options.

2.5 SMS Provider

SMS messages are sent via Twilio, Inc., our authorized SMS service provider. Twilio's privacy practices are governed by their privacy policy, available at https://www.twilio.com/en-us/legal/privacy.

3. Intellectual Property Rights

3.1 Ownership

All content on our website — including text, graphics, logos, images, audio, video, and software — is the property of Surrey Fingerprint Company or its content suppliers and is protected by international copyright laws.

3.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to view and use the website for personal, non-commercial purposes only. You may not reproduce, modify, distribute, transmit, display, perform, publish, or create derivative works from any content without our prior written permission.

4. Disclaimer of Warranties

4.1 As-Is Basis

Our website and services are provided on an "as-is" and "as-available" basis. We make no representations or warranties of any kind, express or implied, regarding the website, content, or services, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted access.

While we strive to provide accurate information and professional fingerprinting services in compliance with RCMP standards, we do not guarantee any particular outcome regarding criminal record checks, background verifications, or any third-party use of fingerprints provided to you. Acceptance or approval of fingerprints by government agencies, employers, or other organizations is beyond our control.

5. Limitation of Liability

5.1 Exclusion of Damages

To the fullest extent permitted by law, Surrey Fingerprint Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or related to:

  • Use of or inability to use the website or services;
  • Unauthorized access to or alteration of your information;
  • Third-party actions or decisions regarding your fingerprints or background check results;
  • Any other matter relating to the website or services.

5.2 Liability Cap

In no event shall our total liability for any claim related to the website or services exceed the amount paid by you for the service giving rise to the claim, or $100 CAD, whichever is less.

You agree to indemnify, defend, and hold harmless Surrey Fingerprint Company, its owners, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the website or services;

  • Your violation of any applicable law or regulation;
  • Your infringement of any third-party rights.

Surrey Fingerprint Company reserves the right to modify these Terms at any time. Changes will be effective upon posting to the website. 11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law principles.

Any legal action or proceeding related to these Terms or your use of the website shall be brought exclusively in the courts located in British Columbia, and you consent to the jurisdiction and venue of such courts.

11.3 Dispute Resolution

Before initiating any legal proceeding, you agree to attempt to resolve disputes informally by contacting us at the information provided below. If a dispute cannot be resolved informally, you may pursue a claim in the appropriate court.

12. Severability
